JPilates Limited Terms and Conditions

Please do not use our website or services if you disagree with any part of these Terms and Conditions.

The following Terms and Conditions have been prepared to help you make the most of JPilates Limited. Please take a few moments to read them thoroughly.

AGREEMENT

1 Interpretation and Variation

1.1 In the Terms and Conditions the following definitions apply:

“JPilates” means JPilates Ltd.

“Student” means any person that has completed and submitted the training registration form and has been accepted by JPilates.

“Tutor” means any person who is employed by JPilates to deliver training and education.

“Terms and Conditions” means these terms and conditions.

“Website” means www.jpilates.co.uk.

1.2 References in the Terms and Conditions to the singular will include the plural and vice versa and references to the masculine gender will include references to the feminine gender.

1.3 The Terms and Conditions are incorporated into the health questionnaire and registration forms

1.4 JPilates reserves the right to vary and revoke the Terms and Conditions from time to time which variation it may consider necessary or desirable for the regulation of the affairs of the training and the conduct of Students. Any such changes will be notified to Students and, until revoked, are and will be binding for Students.

1.5 The Terms and Conditions will be governed by the laws of England and subject to the exclusive jurisdiction of the English courts.

2 Booking and Cancellation

2.1 Receipt of deposit and signed registration form renders the student liable for payment of their full course fees subject to the limitations contained under the cancellation below

2.2 Full course fees are payable regardless of whether the student completes the course

2.3Students who are not up to date with payments will not be eligible to attend workshops, courses or examinations

2.4 If cancellation is received 2 weeks prior to workshop/course commencing then full refund, less 10% deposit (if applicable) will be made. No refunds will be given part way through any workshop/course

2.5 Cancellation of individual modules received 2 weeks prior to course commencing will incur a penalty fee of £35. Failure to attend any given dates without notifying JPilates will also result in this charge being applied

2.6 Students have 1 year to successfully complete an individual course. Extension to this period is on an individual review basis and JPilates is under no obligation to grant such requests

2.7 All bookings must be placed in writing using the relevant registration form(s). Places are not confirmed until forms or payment are received

3 Fitness and Health

3.1 Students are advised not to undertake strenuous physical activities without first seeking medical advice if they have concerns over their physical condition. JPilates reserves the right to refuse access to any Student if, in its absolute discretion, it considers that the health of the individual concerned may be endangered by the use of its facilities.

3.2 Students are required to follow the instructions of the Tutor at all times.

3.3 Students are required to inform a member of staff, if they incur injuries or conditions, after the initial information stated on their health questionnaire.

4 Safety and Hygiene

4.1 In the interests of safety and hygiene, no crockery or glass are permitted in the changing rooms or Studio. No pets (with the exception of guide dogs), are permitted in the Studio. Students must not walk around the Studio barefoot if they have verrucas or similar foot complaints. Please wear socks or indoor flip-flops.

4.2 Students must use the main entrance to the Studio when entering or leaving the Studio. Fire exits, which are clearly marked, are there in the interests of safety and Members must not interfere with these exits for any reason.

4.3 In the event of a fire, Students are asked to make their way to the nearest available exit.

4.4 Smoking is forbidden in the Studio.

5 Personal Belongings

5.1 Personal belongings are brought onto the Studio premises at the Student’s own risk and JPilates does not accept liability for any loss or damage whatsoever to such items.

5.2 Vehicles parked in the Studio car park are parked at the Student’s own risk and JPilates accepts no liability for any loss or damage whatsoever to such vehicle.

6 Limitation of Liability

6.1 Places are subject to availability. JPilates reserves the right to cancel, withdraw, change or relocate a workshop/course within a reasonable time frame. JPilates shall not be held liable for any loss of earnings or expenses as a result of such changes.

6.2 Travel, accommodation and loss of earnings resulting from the attendance of JPilates training are the full responsibility of the Student. JPilates under no circumstances accept any liability for these costs.

6.3 JPilates cannot be held responsible for cancellations caused by circumstances outside of their control. (i.e., weather, travel issues, strikes etc) JPilates will make reasonable attempts to respond to such situations and achieve a satisfactory resolution.

6.4 It is the Student’s responsibility to ensure that he is capable of undergoing a routine of exercises provided by any programme which he follows or session which he attends. Students accept the risk of injury from performing exercises and using specialist equipment and are advised to consult their doctor prior to beginning any session. Advice provided by Tutors at JPilates at no time constitutes medical advice in substitute for advice provided by a medical professional

6.5 JPilates accepts no liability for loss or damage to property of Students or for injury to Students on the Studio premises or outside the Studio except insofar as such loss, damage or injury is by law incapable of exclusion.

6.6 In consideration of their participation in the activities and programmes of JPilates and the use of facilities and equipment owned and/or under the control of JPilates the Student hereby waives and releases JPilates and it’s Tutors from any and all responsibility or liability for injuries or damages resulting from their participation in any of the JPilates’s activities or use of JPilates’s equipment or facilities save in respect of death or personal injury caused by the negligent act or omission of JPilates.

7 General

7.1 All sections of the workshop/course must be completed and a successful pass mark achieved in both written and practical assessments where applicable. No certificates will be issued until all elements of training have been completed to the satisfaction of JPilates

7.2 If JPilates is unable to complete all elements of training within the scheduled time frame, all reasonable attempts will be made to provide the student with supplementary training solutions.

7.3 JPilates reserves the right to eject any candidate from a course after an initial verbal warning with no obligation to reimburse course fees. Dependant on the nature of the incident reasonable attempts may be made to assist the student in completion of training

7.4 JPilates do not allow use of materials provided for any purpose other than the study of the student. Any duplication of all or part of the supplied materials is in direct breach of copyright laws and will result in legal proceedings including full reimbursement of all legal costs incurred

7.5 JPilates workshop/course materials are designed to aid a teacher working with a client. The materials and its content are in no way intended or deemed to be sufficient for any student to subsequently train fellow teachers. JPilates will under no circumstances vouch for any student who proceeds to train fellow teachers using the course content

7.6 Students are required to give notice to JPilates of any change of home address or email address. Failing such notice, all communications will be assumed to have been received by the Student within five days of mailing to the last address (of either type) notified to JPilates

7.7 JPilates may, if a Student so wishes, communicate with the Student by electronic mail (“email”). By providing an email address to JPilates, the Student consents to receiving email communications from JPilates, including notices pursuant to the Terms and Conditions. The Student also accepts the risk that email may not be a secure and confidential means of communication. JPilates will not be liable for any loss or damage suffered as a result of communicating with a Student by email.
